Onebody Health – Membership, Coaching & Nutrition Services Terms & Conditions

These Terms & Conditions (“Terms”) set out our agreement with you regarding the provision of Membership, Coaching, and Nutrition Services by Onebody Health. By signing this agreement, clicking “agree” online, verbally confirming acceptance, or attending a session or consultation, you acknowledge and agree to be bound by these Terms.

1. Acknowledgement & Eligibility

  • You confirm that you have read and understood these Terms and enter into this Agreement voluntarily.
  • If you are under 18, your parent/guardian must consent on your behalf.
  • You acknowledge that participation in training sessions, classes, or nutrition services may involve strenuous activity and inherent risks, and you release Onebody Health and its staff from liability to the maximum extent permitted by law.

 

2. Services Covered

These Terms cover:

  • Membership & Coaching – access to training sessions, classes, and coaching services.
  • Nutrition Services – sports nutrition consultations, program design, and access to digital nutrition content.

Details of inclusions, frequency, and pricing will be provided in your Membership/Coaching package or Proposal.

3. Fees & Payments

  • You agree to pay fees as specified in your Proposal or Membership/Coaching plan.
  • Payments may be made by direct debit, credit card, or upfront invoice.
  • Onebody Health may vary fees with 14 days’ written notice. You may cancel if you do not wish to continue at the revised rate.
  • Dishonoured payments may incur fees, and after 60 days of default Onebody Health may demand full payment plus recovery costs.
  • Onebody Health is not liable for damages resulting from fraudulent or unauthorised payment use.

 

4. Health & Disclosure

  • You must disclose all relevant health information and update us in writing regarding any changes (injuries, illnesses, conditions, pregnancy, allergies).
  • Our services are based on the information you provide; inaccurate or incomplete disclosure may affect outcomes and increase risk.
  • Our services are not a substitute for medical advice. We strongly recommend consulting your doctor before commencing any training or nutrition program.

 

5. Term, Cooling Off, Suspension & Cancellation

  • Minimum Term: Memberships/Coaching & Nutrition Services require a 12-week minimum term. After this, payments continue automatically unless cancelled.
  • Cooling Off: A 7-day cooling off period applies from sign-up. Written notice is required to cancel. Refunds will be processed within 7 days.
  • Cancellation: After the minimum term, 4 weeks’ written notice is required. Pre-paid sessions require 24 hours’ cancellation notice or will be charged in full.
  • Suspension: Membership/Coaching may be suspended for a minimum of 2 weeks with at least 2 weeks’ prior written notice.
  • Nutrition Services: One-off consultations may be cancelled up to 24 hours prior without penalty. For ongoing nutrition services, 30 days’ written notice is required.

 

6. Nutrition Content & Intellectual Property

  • Any nutrition programs, meal plans, exercise guides, or digital materials provided are for personal use only.
  • You must not reproduce, share, or commercialise any content without prior written consent.
  • Intellectual Property Rights remain with Onebody Health or its licensors.

 

7. Service Standards & Limitations

  • Services will be delivered professionally, with due care and skill.
  • Outcomes vary individually; no guarantee of specific results is made.
  • Advice is general in nature and should be applied with professional medical guidance.

 

8. Privacy

We will comply with the Privacy Act 1988 (Cth) and applicable New South Wales privacy laws in handling your personal and health information.

9. Liability & Indemnity

  • Nothing in these Terms excludes your rights under the Australian Consumer Law.
  • To the extent permitted by law, you release Onebody Health from liability for loss, injury, or damage arising from participation in services.
  • You indemnify Onebody Health against losses resulting from your breach of these Terms or misuse of materials provided.

 

10. Rules of Participation

  • You must comply with Onebody Health’s rules, staff directions, and behave respectfully towards staff and other members.
  • Misconduct, including use of performance-enhancing drugs, may result in termination of services without refund.
  • You are responsible for damage you cause to facilities or equipment.

 

11. Marketing Consent

  • By agreeing to these Terms, you consent to Onebody Health using your image, achievements, or testimonials in marketing materials unless you notify us in writing.

 

12. Termination

  • Onebody Health may terminate services with 7 days’ notice or immediately in cases of misconduct, non-payment, or illegal/unethical behaviour.
  • Upon termination, all outstanding fees remain payable and access to nutrition content must cease.

 

13. Dispute Resolution

  • Disputes will first be addressed through good-faith negotiation and, if unresolved, may be referred to mediation by a mediator nominated by the Law Society of New South Wales.

 

14. Changes to Terms

Onebody Health reserves the right to amend these Terms at any time, with updated terms communicated in writing.
